Welcome to SamSurveyor. These Terms of Service ("Terms") govern your access to and use of the SamSurveyor platform, website, and related services (collectively, the "Service") operated by Overturf Industrial Development LLC ("Company," "we," "us," or "our"), located at 1355 Lawrence St NE, Washington, DC 20017, United States.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
SamSurveyor is a platform that enables customers ("Researchers") to design, deploy, and manage AI-powered conversational survey agents. Researchers use the platform to conduct surveys with their own participant lists. Researchers can send invitations through email or Google Chat, and participants complete surveys in Web Chat, by text or voice. The Company provides the infrastructure and tools; Researchers are responsible for their own survey content, participant data, and compliance with applicable laws governing their research activities.
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You must be at least 18 years old and able to form a binding contract to create an account. By registering, you represent that you meet these requirements. If you register on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You agree not to use the Service to:
Organizational Profile Requirements. Before deploying surveys to recipients, you must complete your Organization Profile in full, including your organization's legal/formal name, logo, and a working contact URL. These elements are displayed to survey recipients so they can identify who is conducting the survey and reach you with questions. Providing false, misleading, or non-functional organizational profile information — including dead-end URLs, fictitious organization names, or unrelated logos — constitutes a material breach of these Terms and may result in immediate suspension or termination of your account without notice.
Researchers are solely responsible for ensuring that their surveys comply with all applicable laws and regulations, including but not limited to data protection, privacy, and communications laws.
Phone verification. SamSurveyor does not currently provide survey delivery or customer support through SMS. If you choose to create an account through the Sam Receptionist, we may send a one-time code to the mobile number you provide to verify that you control that number. The verification message is transactional. It is not a subscription to marketing, support, or survey messages. Message and data rates may apply. For help, contact su@samsurveyor.com or call 667-276-8780. Carriers (T-Mobile, AT&T, Verizon, etc.) are not liable for delayed or undelivered messages. For information on how we handle your data, please review our Privacy Policy. We comply with all applicable industry standards for messaging, including the Cellular Telecommunications Industry Association (CTIA) guidelines and the Telephone Consumer Protection Act (TCPA).
Survey delivery by text message. The Service does not include a shared SMS or MMS channel for survey delivery. Survey invitations and interactions are delivered through the Service's common channels: email, Google Chat, and Web Chat. A Researcher who chooses to deliver surveys by SMS or MMS must register and operate their own messaging campaign with their own messaging provider, at their own expense, in compliance with carrier registration requirements (including A2P 10DLC), CTIA guidelines, the TCPA, and all other applicable laws. The Researcher is solely responsible for obtaining any required consent from message recipients, honoring opt-out requests, and all liability arising from their text-message campaigns. The Company is not a party to, and bears no responsibility for, any Researcher-operated messaging campaign.
The Service, including its design, features, software, and content created by the Company, is the property of Overturf Industrial Development LLC and is protected by intellectual property laws. You retain ownership of all content, survey designs, and data that you create or upload through the Service.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms.
"Researcher Content" means all content a Researcher creates, uploads, or transmits through the Service, including survey questions and designs, media files, participant lists, invitation text, and any data or materials included in or distributed with a survey.
Researchers are solely and fully responsible for their Researcher Content and for the consequences of distributing it. By submitting Researcher Content, you represent and warrant that: (a) you own it or have all rights, licenses, and consents necessary to use and distribute it through the Service; (b) it does not infringe or misappropriate any third party's intellectual property, privacy, or other rights; (c) it was not obtained unlawfully; and (d) its distribution to your survey participants complies with all applicable laws.
The Company acts solely as a technology platform. We do not review, endorse, or verify Researcher Content, and we assume no responsibility or liability of any kind for it, including for content that is illegal, infringing, stolen, offensive, deceptive, or otherwise objectionable. We have no obligation to monitor Researcher Content, but we reserve the right to remove any Researcher Content and to suspend or terminate the responsible account, without notice, if we become aware of content that violates these Terms or applicable law.
If you are a survey participant and believe you have received unlawful or inappropriate content through a survey, contact the Researcher identified in the survey's Organization Profile. You may also report the content to us at su@samsurveyor.com.
We respect the intellectual property rights of others and expect Researchers to do the same. If you believe that content available through the Service infringes your copyright, send a notice to our designated agent at su@samsurveyor.com (subject line "DMCA Notice") that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (c) your name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (f) your physical or electronic signature.
Upon receiving a valid notice, we will remove or disable access to the identified material and notify the Researcher who provided it. The Researcher may submit a counter-notice as provided by 17 U.S.C. § 512(g); if we receive one, we may restore the material unless the complaining party files a court action within the statutory period. We will terminate the accounts of Researchers who are repeat infringers.
As described in our Privacy Policy, we act as a data processor with respect to survey respondent data. Researchers are the data controllers and are responsible for obtaining all necessary consents from survey participants and for compliance with applicable data protection laws, including any institutional approvals (such as IRB review) their research requires.
With respect to survey respondent data, we agree that: (a) the Researcher owns all survey responses, transcripts, and voice recordings collected through their surveys; (b) we process this data only to provide and support the Service and as directed by the Researcher through the platform, and not for our own purposes; (c) we implement appropriate technical and organizational measures to protect the data; (d) we use subprocessors (such as our cloud hosting and AI service providers, listed in our Privacy Policy) only under contracts that limit their use of the data to providing services to us; (e) we will make survey data available for export in standard formats during the term of the account; and (f) upon account termination, we delete associated survey data in accordance with the retention schedule described in our Privacy Policy, except where law requires longer retention.
This section constitutes the parties' data processing terms. Where the EU or UK General Data Protection Regulation applies to a Researcher's use of the Service, this section applies to the extent required by Article 28, and Standard Contractual Clauses are incorporated where required for international transfers.
The Service uses artificial intelligence, including large language models, to conduct conversational surveys, interpret responses, and extract structured data. AI-generated content and extractions may contain errors or inaccuracies. The Company does not warrant the accuracy or completeness of AI-generated interpretations of survey responses. Researchers are responsible for reviewing collected data before relying on it and for determining whether the Service is suitable for their research purposes. The Service is not designed for use in situations where an inaccurate response could cause harm, including emergency response and medical diagnosis.
Certain features of the Service may require payment. Current pricing is available on our Pricing page. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing at any time with reasonable notice.
You may terminate your account at any time by contacting us at su@samsurveyor.com. We may suspend or terminate your access to the Service for material breach of these Terms (including violations of Sections 3 and 6), for non-payment, or where required by law. For paid accounts terminated without cause by the Company, we will provide at least 30 days' notice.
Upon termination, your right to use the Service ceases. For 30 days following termination (except termination for a serious violation of Sections 3 or 6), we will make your survey data available for export on request, after which it is deleted in accordance with our retention schedule. Sections 5, 6, 8, and 9 through 17 survive termination as applicable.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERTURF INDUSTRIAL DEVELOPMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO THE COMPANY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless Overturf Industrial Development LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your Researcher Content (including any claim that it is unlawful, infringing, or was obtained or distributed without authorization), your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the District of Columbia.
We reserve the right to modify these Terms at any time. We will provide notice of changes by posting the updated Terms on our website with a new "Last Updated" date and, for material changes, by notifying registered users by email before the changes take effect. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be provided by email to the address on your account.
